
The Regulation Amending the Remote Working Regulation (the “Regulation”) was published in the Official Gazette dated 25 September 2026 and entered into force on the same date. With this amendment, the hybrid working arrangement has been expressly provided for under the Remote Working Regulation and has been given a legal framework.
Remote working was regulated in detail in Türkiye for the first time by the Remote Working Regulation, which was prepared on the basis of Article 14 of Labor Law No. 4857 (the “Labor Law”) and entered into force on 10 March 2021. Within this framework, the procedures and principles governing the remote working model, which became widespread particularly after the pandemic, were placed on a statutory foundation.
However, although the originally published version of the Remote Working Regulation contained no provision on the hybrid working arrangement, this arrangement has come to be widely applied over time by many workplaces. With the said amendment, the hybrid working arrangement already in use has been given an express provision within the scope of the Remote Working Regulation.
Article 9, which is the amended article, regulates how working time is determined in the remote working process. Before the amendment, the article merely provided that the time frame and duration of remote work must be specified in the employment contract. With the second paragraph added by the amendment, it is now provided that where part of the work is performed at the workplace and part through remote working, the employment contract must expressly state which days will be worked at the workplace and which days remotely.
Although the new provision does not introduce a new form of work, it expressly codifies in the Regulation the hybrid working model that is already used in practice. Accordingly, in order to avoid uncertainty between the parties as to the scope of the working arrangement, it is important for employers to expressly state in employment contracts the days to be worked at the workplace and remotely, as well as the working hours.
